Conditions of Membership and Waiver of Risk and Liability
In becoming a member of the Toronto Boardsailing Club (operating as Toronto Windsurfing Club) each of the
undersigned recognizes the inherent risks of windsurfing (Òthe sportÓ), agrees to assume all responsibility for his/her own actions, is aware of his/her personal limitations and abilities, and will respect these in the practice of the sport
Each of the undersigned, for him/herself and, where applicable, his/her family members listed in this application, their respective heirs, executors and administrators do hereby remise, release and forever discharge and hold harmless and indemnify TWC, its directors, officers, employees, agents and guests (collectively, the ÒPartiesÓ) from and against any and all claims, actions, causes of action, complaints, demands for loss, damage, injury or death to his/her person (or, where applicable, the person of his/her family members listed in this application) or property, howsoever caused in
activities at or in connection with TWC
Each of the undersigned is aware of and agrees to abide by all applicable laws and the rules and safety regulations of the water ways and otherwise including, without limitation, carrying a personal floatation device, whistle and signalling device on board and observing right-of-way rules.
Each of the undersigned agrees to assume all risk and liability of all kinds arising from the use of the premises and facilities of TWC by guests of the undersigned or family members not listed in this application.
Each of the undersigned is aware that TWC is a volunteer organization and agrees to volunteer time to the betterment of the club.
Each of the undersigned is aware of his/her responsibility to remove his/her equipment from TWC’s facilities upon expiry of the term indicated in this application or to make arrangements with TWC for an additional term.
Each of the undersigned acknowledges and agrees that equipment left beyond the indicated term may be deemed abandoned and may be disposed of by TWC by the methods which it deems best and all proceeds from such disposition may be retained by TWC for its own account and use.
Each of the undersigned acknowledges and agrees that TWC is not responsible for loss of or damage of any nature or kind to personal belongings stored or left at TWC facilities by theft, fire or other means.
Each of the undersigned understands that it is his/her personal responsibility to arrange for insurance to cover such losses.
Each of the undersigned agrees to abide by the by-laws of TWC.
